Established by the Constitution of Malawi, the Malawi Judiciary is an independent arm of government that is led by the Chief Justice and it is divided into three categories namely: 1) The Supreme Court of Appeal, which is the court of appeal (Sec 104), 2) The High Court of Malawi (Sec 108) which has four divisions (Civil Division, Commercial Division, Revenue division and Criminal division), and 3) The Subordinate Courts (Sec 111) which are Magistrate Courts and the Industrial Relations Courts. Among others, the judiciary exists to promote, protect and up-hold the rule of law, democracy, human rights and the Constitution

The Parliament of Malawi is the supreme legislative body in Malawi. It is composed of the President and Members of Parliament (MPs) that are elected directly in single member constituencies. It is headed by the Speaker elected by MPs on the first day of their sitting following elections. Currently, the Parliament of Malawi is composed of 193 Members representing the 193 constituencies. The Malawi Police Service (MPS) is a Malawi Government organ currently under the Ministry of Internal Affairs and Public Security. Its operations are provided for under the laws of Malawi, notably in the Constitution of the Republic of Malawi and the Malawi Police Service Act (MPS Act 2010). Its mandate includes Prevention, investigation and detection of crime; Apprehension and prosecution of offenders; Maintenance of law and order; Protection of property, life, fundamental freedoms and rights of individuals; and Enforcement of all laws and regulations under which they are directly charged
