Established by the Constitution of Malawi, the Malawi Judiciary is an independent arm of government that is led by the Chief Justice and it is divided into three categories namely: 1) The Supreme Court of Appeal, which is the court of appeal (Sec 104), 2) The High Court of Malawi (Sec 108) which has four divisions (Civil Division, Commercial Division, Revenue division and Criminal division), and 3) The Subordinate Courts (Sec 111) which are Magistrate Courts and the Industrial Relations Courts. Among others, the judiciary exists to promote, protect and up-hold the rule of law, democracy, human rights and the Constitution
